Local Listed Building Consent Order (LLBCO)

We are progressing work on a Local Listed Building Consent Order (LLBCO) for the installation of solar panels on listed buildings within the Bath Conservation Area.

What an LLBCO is

Introduced in the Enterprise and Regulatory Reform Act 2013, LLBCOs provide consent for certain types of works that would otherwise require listed building consent. An LLBCO can also specify an area or a type of building to which it can apply, any exemptions, and any conditions or requirements with which works must comply. This is to ensure that works would not harm or have a negative impact on the historic environment, in line with national policy.

The purpose of an LLBCO is to remove the requirement for individual listed building consent applications for certain types of works and streamline the process for listed building owner-occupiers and the local planning authority.

Works covered by the LLBCO

The proposed order is for the installation of solar panels on the inner roof slopes of M-shaped double pitch roofs within a concealed inner valley. This will apply to all Grade I, II*, and II listed buildings located within the Bath Conservation Area (with the exception of ecclesiastical buildings currently in ecclesiastical use) where it can be demonstrated that works would meet the conditions set out in the LLBCO.

One of Bath's many distinctive features is its homogenous form and building typology, particularly within the city centre, largely characterised by the presence of terraced town houses with M-shaped double pitch roofs. The inner valleys of roofs are of very limited visibility and a suitable location for the installation of solar panels without impact to the appearance or significance of a listed building.

The LLBCO will remove the requirement for listed building consent for the installation of solar panels on inner roof valleys, subject to conditions. The order is being considered for an initial period of six years, with the potential to be extended if successful.

Please note that in the case where planning permission may be required for installation of solar panels, this would remain unaffected by the order. Please refer to our guidance about planning restrictions in conservation areas.
