Anti-Social Behaviour (ASB) Case Review Privacy Notice

The purpose of processing

We process personal information to administer and conduct statutory Anti-Social Behaviour (ASB) Case Reviews. This includes reviewing how relevant agencies have responded to reports of persistent anti-social behaviour and agreeing actions or recommendations where responses have not been adequate. The ASB Case Review process is established in law and is intended to ensure a coordinated, victim-centred, multi-agency response to persistent anti-social behaviour.

Data subjects

This privacy notice applies to the following groups of people:
Victims of Anti-Social Behaviour (ASB)
Individuals applying for an ASB Case Review on behalf of the victim
Alleged perpetrators of anti-social behaviour
Witnesses
Other individuals whose information is relevant to an ASB Case Review

Personal data

We may collect and use the below types of personal data (including special category) where relevant.

Financial data is not collected as part of the ASB Case Review process. Only information that is necessary, relevant and proportionate for the purposes of the ASB Case Review will be processed.
Name, address and contact details (including email addresses and telephone numbers)
Details of reported incidents, including dates, locations and descriptions
Case history and records of reports made to the Council or partner agencies
Professional opinions, assessments and actions taken by relevant organisations
Location-based information linked to reported incidents
Physical or mental health information
Disability
Vulnerability or support needs
Safeguarding information relating to children and adults
Alleged criminal behaviour
Enforcement action, investigations and outcomes

How is it used?

We will use your personal data for the below purposes.

This may include information provided in different formats (for example written records, audio or visual material), where relevant and proportionate to the ASB Case Review.
Receiving and assessing Anti Social Behaviour (ASB) Case Review applications
Determining whether the statutory threshold for a Case Review is met
Requesting and considering information from relevant partner agencies
Conducting multi-agency Case Review meetings where required
Assessing harm, risk and persistence of anti social behaviour
Identifying safeguarding concerns and making referrals where appropriate
Agreeing, recording, and monitoring actions or recommendations
Communicating decisions and outcomes
Meeting statutory audit and governance requirements

Profiling and automated decision making

Sharing of personal data with external recipients

Personal data may be shared, where necessary and proportionate, with organisations involved in the ASB Case Review process, including the below.

Information is shared only for the purpose of carrying out an ASB Case Review; only with organisations involved in the specific case; and in line with data protection legislation and information-sharing arrangements. Each organisation acts as its own Data Controller for the information it holds.
Avon & Somerset Police
NHS Bath & North East Somerset, Swindon & Wiltshire Integrated Care Board
Registered Providers of Social Housing
Council services (E.g. Community Safety, Housing, Environmental Protection, Adult Social Care and Children’s Social Care, etc)
Youth Justice Service, Probation and education providers
Avon Fire & Rescue Service
Specialist support services where relevant

How long is the personal data retained by the Council?

Personal data will only be retained only for as long as it is needed for the purpose of conducting an Anti-social Behaviour (ASB) Case Review, including any follow-up actions, safeguarding considerations, appeals or legal challenges. Personal data will be retained as required by applicable law or regulatory requirements. Retention is managed in line with the Council’s approved retention schedules and statutory requirements.
