In 2013 the Council agreed to a programme of transferring community based assets and services to voluntary groups and parish councils, beginning with a series of “Quick Wins” alongside the development of a more detailed framework and criteria.   Since then there have been a number of successful Community Asset Transfers, for example for example Scout land at Kelston Rd, Alexandra Bowls Club, S&D Heritage Railway.

The draft Community Asset Transfer Policy builds upon the work already undertaken and will form part of the Corporate Asset Management Plan.

It provides a detailed framework and criteria for organisations wishing to apply.  It follows the principles set out in the guidance document produced by “Locality” on Community Asset Transfer and examples taken from other local authorities including Bristol City Council, Isle of Wight and Wigan Council. 

Why are we consulting?

The Council has a legal duty under s123 of the Local Government Act 1972, when disposing of assets that have a leasehold interest over seven years to ensure it obtains the “best consideration” reasonably obtainable.  However, the General Disposal Consent (England) 2003 can be applied where the local authority can demonstrate long-term social, economic and environmental benefits.

It is proposed that the Council will operate a four staged process when considering Community Asset Transfers:

  • Assessment of the Asset,
  • Expression of Interest,
  • Business plan, and;
  • Completion. 

Defining a more structured process and offering more support to the community, it is hoped that organisations will understand their responsibilities, provide good governance and have the financial capability to manage the asset, thereby securing the long term viability of the asset.  

The consultation will run from 17th December 2018 until 25th January 2019.

What happens next: 

The feedback from the consultation will be reviewed and summarised and changes to the draft policy will be made where appropriate.  The results of the consultation along with the updated policy and guidance will be presented to Cabinet on the 6th February 2019.
