Duty of Care for waste: why should you care?

Everyone who has bulky or hazardous waste that cannot be collected by the Council’s regular refuse or recycling services has a legal Duty of Care to dispose of it at a proper recycling centre or by hiring a registered waste carrier (see below).

If fly-tipped rubbish is traced back to you, you’ll be held responsible and could face a fine of up to £5,000. To avoid a fine, you should always ask to see your waste-carrier’s licence.

About registered waste carriers

If you ask or hire anyone to take bulky waste from your home, they must be registered with the Environment Agency to carry waste.

They could be skip companies, scrap metal merchants, gardeners, electricians, plumbers, tree surgeons, carpet fitters or builders or any trades-person working on your home.

Always ask to see their license, issued by the Environment Agency.

What’s your Duty of Care for waste?
  • The Duty of Care is set out in section 34 of the Environmental Protection Act 1990 and associated regulations.
  • Only give waste to a registered waste-carrier
  • Ensure do-it-yourself, building and gardening waste is disposed of at a registered site Check that trades-people who take away waste for you hold a valid Environment Agency licence
  • in doubt, do an Instant Waste Carrier Check on 08708 5066 506
  • Give your waste-carrier a transfer form and keep a copy for two years
  • Report fly-tippers or carriers operating without a permit on 01225 39 40 41
