Required for all major development. (Major applications are developments of 10 or more dwellings, residential sites of 0.5 ha or more, and other buildings with a floor space of 1,000m sq or on sites of 1 ha or more, and all waste applications).

Planning obligations, or Section 106 Agreements are private agreements negotiated between local planning authorities and persons with an interest in a piece of land or developers, and are intended to make acceptable development which would otherwise be unacceptable in planning terms. 

The council's approach to planning obligations are set out in Supplementary Planning Document -  Planning Obligations - adopted 6 April 2015.

Applicants are encouraged to use the pre-application guidance offered by Bath & North East Somerset Council. At the pre-application stage, details of the draft obligation(s) being proposed should be submitted along with details of the applicant’s solicitor and also proof of title regarding land subject to the planning obligations.
