Hackney Carriage Vehicle Licence

Summary

If you wish to use a vehicle as a Hackney Carriage in Bath and North East Somerset you need to obtain a licence from the Council.

All licences will expire on 31 May.  There is no pro-rata fee structure.

Application Form

Applications must be made on forms provided by the Council.  The following will be required on application: 
  • Application Form (to be completed at time of application).
  • Registration document.
  • Current insurance certificate which must cover the vehicle for hire and reward.  Insurance certificates should only show licensed drivers.  Insurance certificates that include unlicensed spouses or partners will not be accepted.
  • MOT certificate for all vehicles over one year old on date of application.
  • Fee (current fee in force at time of application).
  • Mechanical Inspection Certificate (from nominated Council Garage).
  • Measured mile meter compliance certificate (if vehicle fitted with a taximeter).

Eligibility Criteria

  • All vehicles must be presented for a visual inspection by an Authorised Officer prior to being approved for the purpose of Hackney Carriage licensing.  Vehicles should be less than five years old on the date of the first application for a Hackney Carriage vehicle licence.  It is advisable to consult a Licensing Officer before purchasing a prospective vehicle.  All vehicles must be approved by a Licensing Offcer.  If you purchase a vehicle without consulting a LIcensing Officer you do so at your own risk.

  • The engine size of the vehicle must be at least 1400 cc and shall have three doors which are accessible to fare paying passengers wishing to enter or exit the vehicle.

  • Vehicles shall comply with the European Community M1 type approval for passenger carrying vehicles.  The definition of category M1 type approval is any motor vehicle with at least four wheels designed and constructed for the carriage of passengers.

  • Vehicles that have been originally classified as complying with M1 type approval but have undergone modifications or conversions since original manufacture will be considered suitable provided they are presented with the relevant Individual Vehicle Approval (IVA) or Single Vehicle Approval (SVA) certificate issued by the VOSA. 

  • Any vehicle submitted for licensing originally given European Community N type approval will be considered unfit for the purpose and will not be licensable as a Private Hire vehicle.  The definition of category N type approval is any motor vehicle with at least four wheels, designed and constructed for the carriage of goods.  Type approval status can be found on the vehicle registration document (V5C).

Process

Postal applications will not be accepted.

Objections

Vehicles which do not comply with the Council's licensing conditions will be referred to the Council’s Licensing Sub Committee for determination.

Right of Appeal 

If you wish to appeal a Council decision to: 

  • refuse to grant an application; or
  • attach any condition to the licence

you can appeal to Bath Magistrates’ Court within 21 days of being notified of the decision.

A decision of the Magistrates’ Court can be appealed to the Crown Court.

  • It is a matter for each individual to ensure that they are familiar with all the relevant legislation including the current conditions of licence.
  • Hackney Carriage vehicles may ply for hire, or use Hackney Carriage ranks, to stand for immediate hiring.
  • Vehicles must comply with the requirements of the Road Traffic Act 1988 and any other Act relating to motor vehicles, or any other subsequent Acts, and of the Orders and Regulations made in pursuance thereof.
  • Under the Local Government (Miscellaneous Provisions) Act 1976, even after a vehicle has been licenced, if it is found to reveal any defect which, in the opinion of the Authorised Officer or the Police, renders it it unsuitable for public service, the Authorised Officer or the Police may serve a s68 notice on the proprietor not to use such vehicle until the defect has been remedied to the satisfaction of the said Officer or Police.

Validity/Renewals

The period of the licence will normally be 12 months from 1 June to 31 May, but the Council reserves the right to issue licences for a shorter period.

Any application to renew a licence received after the current one has expired will be treated as a new application.  If a higher fee is in force for new applications than for renewals, then that higher fee shall be payable.
