All streets within Bath and North East Somerset have been designated consent streets which basically means that you need permission to trade from any street or highway within the authority.

Direct Debits

If you would like to pay by monthly direct debit in order to spread the cost more evenly throughout the year, we will give you a discount on the above daily pitch fees.

Application Form 

If you wish to apply for a street trading pitch in Bath and North East Somerset, you should:

 

1.  Carefully consider the Council’s Street Trading Policy.

2.  Carefully consider the Council’s Street Trading Standard Conditions.

3.  Complete the Street Trading Pitch Request Form and submit to us for consideration.  We will then make a decision based on the information you have provided.  If we feel it is appropriate for the location we will contact you to proceed with the application process.  You will then need to pay the required application fee.

 

Please note that if you intend to sell food, you may need to complete a food registration form.  Further information is available on the Food Safety Team's webpage.

Eligibility Criteria 

Applicants must be at least 17 years of age to hold a consent.

Application Process and Consultation 

On receipt of a valid application we will proceed as follows:

If the application is for either:

  • an existing pitch which is currently vacant and you wish to sell goods which are significantly different to those previously agreed at that location; or
  • the creation of a new pitch;

then we will consult with:

  • Development Control/Planning
  • Highways
  • Property Services
  • Police
  • Local Ward Councillor(s)
  • Environmental Health Food Team (if food is to be sold)
  • Adjacent Premises 
  • Parish and Town Councils (where applicable)

A public notice will also be placed on the highway for a period of 21 days.

If the application is for an existing pitch and the goods you wish to sell are not significantly different to those previously agreed at that location, then no consultation process will be required.

 Objections

Anyone wishing to make an objection to an application must give written notice of their objection to Licensing Services, stating the grounds of the objection, within 21 days of the date of the application.

Evaluation

We must allow 21 days for objections to be made.  If any objections are received, the application will be referred to the Council’s Licensing Committee for determination.

However, if no objections are received by the end of the consultation period we can proceed as follows:

  • An appointment will be made for you to visit our offices for a new trader interview with a Licensing Officer.  He will provide you with information about our policy and the conditions attached to your licence.  At the same time he will make your photo ID badge(s) and take you to the location of the pitch so it clear where you will be trading from;
  • You will need to pay the pitch fee based on the number of trading days to the end of the current quarter, or set up a direct debit arrangement;
  • You will need to pay a badge fee and deposit;
  • Your Street Trading Consent will then be issued. 

There is no statutory period for determining applications; however, we aim to determine applications within 60 days.

Tacit Consent 

Tacit consent applies.  This means that you will be able to act as though your application is granted if you have not heard from the local authority by the end of the 60 day target completion period. 

Right of Appeal 

Please contact Licensing Services in the first instance. 

Conditions 

Permits are subject to a set of standard conditions.

The Council may also add conditions specific to your pitch if it considers it necessary.

Validity/Renewals 

Unless a shorter period is specifically stated, all consents will be granted for the following periods:

  • One year - for those applicants paying their fee by monthly direct debit; or
  • Three months - for those applicants paying their fee by other methods.

 If you have a complaint about a trader, we would advise you first to contact the trader – preferably by letter with proof of delivery.  If that is unsuccessful and you are in the UK, the Citizens Advice Bureau will assist you.  If you are outside of the UK, contact the UK European Consumer Centre.
