Prize Gaming Permit

Summary

Prize gaming is gaming where the organiser puts up the prizes in advance, as distinct from gaming where the stakes of the participants make up the winnings.  It is intended to permit low level gaming for small participation fees and modest prizes.  It can comprise of a variety of games, providing that the participation fees and prizes do not exceed prescribed limits.

 

A prize gaming permit will allow a person to provide facilities for gaming, like those above, on specified premises.  Any premises that does not have a Premises Licence under the Gambling Act 2005 that wishes to provide such gambling would need to apply for a prize gaming permit.

Eligibility Criteria 

  • An application for a permit can only be made by a person who occupies or plans to occupy the relevant premises.
  • If the applicant is an individual, he or she must be aged 18 or over.
  • Holders of premises licences under the Act and holders of club gaming permits may not apply for prize gaming permits.
  • Applicants are not required to have an operating licence issued by the Gambling Commission.

Application
Process

On receipt of a valid application we must consult with Avon and Somerst Officer of Police.  We will forward a copy of your application to them and they will have 14 days in which to make any comments. 

Evaluation 

We can either grant or refuse an application for a permit, but we cannot add conditions.  Should we decide to refuse an application we will write to you with our reasons and you will be given the opportunity to make representations against our decision.

Tacit Consent 

The Gambling Act 2005 is not subject to the EU Services Directive and tacit consent does not apply.

Conditions 

Compliance with the Gambling Commission Code of Practice is a condition of any permit or notification. 

Validity/Renewals 

A permit lasts for 10 years.  There is no annual fee for this type of permit.

The Council's Statement of Principles outlines the principles it proposes to apply when exercising its functions under the Act.
