From the 31st March 2008 the Traffic Management Act 2004
(TMA) replaces the Road Traffic Act 1991 and the various London
local authorities and Transport for London acts.
This provides the legislation which governs how we enforce
parking regulations.
The TMA was introduced to tackle congestion and disruption on the
road network and places a duty on local authorities to ensure the
smooth running of traffic on their road network. The Act gives
local authorities additional tools to better manage parking
policies, moving traffic enforcement and the co-ordination of
street works.
B&NES enforcement policy looks to follow the guidelines laid
down by The Act, with particular regard to:
- managing the highway network to ensure the efficient flow of
traffic
- improving road safety
- improving the local environment
- improving the quality and the accessibility of public
transport
- meeting the needs of people with disabilities
- managing and reconciling the competing demands for kerb
space
- promoting compliance with traffic and parking regulations
amongst drivers
What are the main changes?
The aim of the act is to provide a framework which is both fair
to the motorist but still effective in enforcing parking and
traffic regulations both inside and outside of London.
From the 31st March 2008 parking attendants will be known as civil
enforcement officers, and will continue to enforce parking
regulations on-street.
CCTV and mobile CCTV vehicles will be used to enforce parking
and traffic regulations in areas of high congestion levels and
parking stress.
The wording on the Penalty Charge Notice (PCN) will also change
to reflect provisions of the new act.
Penalty Charges for Parking Contraventions
NOTICE is hereby given that from 1st April 2008 the
implementation of civil parking enforcement becomes effective in
Bath and North East Somerset. Regulations under Part 6
of the Traffic Management Act 2004 require the introduction of
variable charges for penalty charge notices and each Local
Authority must set the level of penalty charges within specified
Bands. Bath and North East Somerset Council has set the level
of charges for parking contraventions as follows:
