Penalty Charge Notices (PCN)
GROUNDS FOR APPEAL
If you are not sure which of the six statutory grounds apply to
your circumstances this will not prevent you from having your
representation considered by the Council.
The six statutory grounds are:
- The contravention described on the PCN did not occur
- The penalty exceeded the relevant amount
- The traffic order is invalid
- You did not own the vehicle when the PCN was issued
- You are a hire company and the hirer has signed a formal
agreement accepting liability for PCN's.
- The vehicle had been taken without my consent
1. The contravention described on the PCN did not occur
for instance if the PCN is for overstaying in a bay and the time
had not expired, or if the PCN is for parking on a yellow line and
you were in fact legally loading.
2. The penalty exceeded the relevant amount
If the PCN asks you to pay more than you are legally liable
to.
3. The traffic order is invalid
If you can demonstrate that the parking restriction in question
was invalid or illegal. This applies for instance if the Council
has not followed the correct procedure for passing the traffic
order.
4. You did not own the vehicle when the PCN was issued
- Please supply details such as a receipt of sale/purchase. A
copy of the DVLA registration form to show the name and address of
the owner on the date of issue.
5. You are a hire company and the hirer has signed a formal
agreement accepting liability for PCN's.
- Please supply a copy of the statement they signed.
6. The vehicle had been taken without my consent
If the vehicle was stolen when the PCN was issued then please
supply evidence such as the Police report and/or an insurance
claim.
How to Appeal
