BATH) COMPULSORY PURCHASE ORDER 2004
(2) STOPPING UP OF HIGHWAYS (BATH AND NORTH EAST
SOMERSET) (NO. SW ) ORDER 200
NOTICE IS HEREBY GIVEN that a public local inquiry into
these matters will be held at the Hilton Bath City Hotel, Walcot
Street, Bath commencing on Tuesday 17 May 2005 at 10.00 a.m. The
inquiry will be held by Mrs Wendy Burden BA(Hons) DipTP MRTPI a
person appointed by the First Secretary of State and the Secretary
of State for Transport.
(1) WHEREAS Bath and North East Somerset Council have
submitted to the First Secretary of State for confirmation an Order
made by them under Section 226(1)(a) of the Town and Country
Planning Act 1990, the Local Government (Miscellaneous Provisions)
Act 1976 and the Acquisition of Land Act 1981, which would
authorise them to acquire compulsorily land and ~ew rights in the
land referred to in the Schedule hereto for the purpose of securing
the carrying out of a comprehensive scheme of redevelopment
(including retail, residential and leisure uses, together with car
parking, alterations to the highway network and the provision of a
new public transport interchange) at Southgate, City Centre,
Bath.
A copy of the Order and of the maps referred to therein are on
deposit at the offices of Bath and North East Somerset Council, at
Trimbridge House, Trim Street, Bath BA1 2DP and may be seen there,
on application, at all reasonable hours.
SCHEDULE
Land and buildings approximately 5 hectares in area in the City
Centre, Bath, bounded by and includes all or part of New Orchard
Street and Henry Street to the north, Manvers Street to the east,
Bath Spa railway station and the River Avon to the south, and
Southgate Street to the west. The Order also includes land in the
vicinity of the Churchill Bridge Gyratory.
(2) WHEREAS the Secretary of State for Transport has
published his intention to make an Order under Section 247 of the
Town and Country Planning Act 1990, authorising the stopping up
of?~reas ofhignw8Y at New Orchard Street, Kingston Road, Southgate,
Marchants 'f,?~'~sage,Newark Street, Railway Street, Railway Road,
Railway Place, Henry Street, Manvers Street, Dorchester Street,
Broad Quay, Philip Street, Ham Gardens, Bath, referred to in the
Schedule, to enable development authorised by planning permission
(demolition of existing buildings and structures, and redevelopment
of the South gate area for residential [Class C3]; retailing
[Classes A 1, A2 & A3]; indoor leisure [Class D2 {excluding
cinema}]; offices [Class B1]; bus station/public transport
interchange and related facilities; public conveniences; car
parking; servicing; works to Dorchester Street and Manvers Street
and related access and highway works; streets and public spaces and
landscaping; works to Bath Spa Railway Station and forecourts to
north and south, including the installation of lifts and
alterations to the station vaults; works to the electricity
transformer; works to the Argyll Hotel Building, relocation of
listed telephone boxes; and related engineering and landscaping
works) to be carried out. If authorised, the stopping up Order
would remove all rights of way by the public over the highway.

SCHEDULE
The areas of highway to be stopped up are at New Orchard Street,
Kingston Road, Southgate, Marchants Passage, Newark Street, Railway
Street, Railway Road, Railway Place, Henry Street, Manvers Street,
Dorchester Street, Broad Quay, Philip Street, Ham Gardens, Bath, in
Bath and North East Somerset.
They are shown edged black on the deposited Plan (1) and are
described in the table on Plan (2).
