Environmental Permits

The Environmental Permitting (EP) Regulations came into force in England and Wales on 6th April 2008.

The purpose of the new EP regime is to streamline and combine separate waste and pollution control systems so there is now a single, simpler, modern environmental permitting system.

Do I need an environmental permit?

The Environmental Permitting Regulations and the Pollution Prevention and Control Act 1999 categorises installations into Part A1, Part A2 and Part B.

Part A1 installations are regulated by the Environment Agency.

Part A2 and Part B activities are regulated by the local council.

If you are unsure if you need a permit check with your environmental regulator, either:

The following activities require a permit:

  1. an installation carrying out the activities listed in Schedule 1 of the EP Regulations. These include activities in the energy, metals, minerals, chemicals and waste sectors.
  2. a waste operation. This includes the disposal or recovery of waste which is not exempt under the EP Regulations.
  3. a mobile plant carrying out one of the above activities or waste operations.

What do I need to know about the application procedure

From receipt of a Duly Made application the regulator has up to 4 months to issue the permit. The reason for this time is because the regulator may need to consult with interested parties such as the Environment Agency and Natural England, for example. Consultation may need to be undertaken both for new applications and substantial change applications.

On top of the need to consult with statutory bodies the regulator has the option to advertise the application in a local newspaper. This is usually done where the application is likely to give rise to local controversy, or where the activity subject to the application could have impacts wider than the immediate vicinity, and a newspaper advertisement will be the best way of alerting potentially interested people.

When is an application Duly Made

An application is Duly Made when all the information required by the local authority to make a determination has been received. If an operator fails to do this, the authority may have to request additional information, delaying the determination.

An application is not treated as duly made when for instance:

  • it has not been submitted on a standard form
  • it is for an installation that falls outside the remit of LA-IPPC or LAPPC regimes
  • it has been sent to the wrong regulator
  • it has not addressed some key points, or there is substantial and obvious doubt about the basic adequacy of a key part of the application
  • the declarations have not been completed
  • the operator is not a legal entity, or
  • the necessary fee has not been paid.

Surrender of the Permit (in whole or part)

An operator may apply to surrender their permit in whole or in part by completing the application. An application must be made on the surrender form available from Environmental Services or from the link below.

The surrender of the permit will be accepted if we are satisfied that the following measures will be achieved:

a) potential pollution risk resulting from the operation or its cessation is avoided

b) the site is returned to a satisfactory state, having regard to the state of the site before the installation was put in operation

Where paid quarterly the total amount payable to the local authority will be increased by £35. There is no extra fee payable to the Environment Agency where quarterly payments are made.

In the case of a discharge consent local authority permit, 56% of the annual charge that would be payable under the Environment Agency Discharges to Controlled Waters Charges Scheme in relation to the financial year if the discharge or discharges authorised by the permit were permitted by a consent given or served by the Environment Agency under Part III of the Water Resources Act 1991, is payable to the Environment Agency.

Newspaper advertisements

Newspaper adverts may be required under EPR at the discretion of the LA as part of the consultation process when considering an application (see Chapter 9 of the General Guidance Manual). This will be undertaken and paid for by the LA and the charging scheme contains a provision for the LA to recoup its costs.
