Tables and Chairs on the Highway
Outdoor seating and tables add important vitality to the
environment. A number of pubs, restaurants, wine bars
and cafés may wish to have tables and chairs outside
their premises for the use of their customers. Where the
pavement concerned is part of the public highway, planning
permission and a highway licence will need to be obtained under the
Local Government (Miscellaneous Provisions) Act 1982 and Part VIIA
Highways Act 1980. This is to ensure that adequate space is
available for the safe and free movement of all highway users and
that consideration is given to the location of the amenity in terms
of possible noise disturbance for local residents and nearby shops
and offices.
Fees
The application fee is £217 (non returnable) plus £58
per table.
The fee for a transfer of the permit is £10.50.
NB Fees stated are for the period 1 April 2008 - 31 March
2009.
Alcohol
Under the Licensing Act 2003 you will need to
incorporate this in your application for a premises
license.
