Identifying a New Street Trading Pitch

Advice for Applicants

Applicants who wish to trade from a location which is not currently recognised as an official street trading pitch in the Bath and North East Somerset area will need to note the following:

1.  Carefully consider the Council’s Street Trading Policy.

2.  Carefully consider the Council’s Street Trading Standard Conditions.

3.  Identify the pitch location.  Ensure that it is not privately owned.

4.  Make enquiries with neighbouring houses, businesses and anyone else who you think may be affected.

5.  Applications should be in the form of a letter (no application form required at this stage), and include:

  • details of the goods you wish to sell
  • number of trading days per week
  • trading hours per day
  • sketch or photograph of intended stall
  • a plan or map of the site that will enable licensing team to easily identify the location from which you wish to trade
  • any other supporting information

    Applications received without the above information may not be considered.

6.  The licensing team will then consider your notice of intention.  If your pitch is considered to be appropriate they will send you an application form.  You must complete this form fully and return it together with the non-refundable application fee.

7.  A notice will be placed on the proposed site for a period of 21 days starting on the day that the application is received.

8.  A consultation process will then be carried out involving notification of the application being sent to the police, highways, food team, environmental protection, planning, local councillors and where applicable town councils, parish councils and nearby businesses and residents.

9.  If no objections are received after 21 days then the Consent will be issued.

10.  If an objection is received then it will be necessary to refer the decision to the Council’s Licensing Sub Committee for a decision to be made.  This will involve a hearing (usually held in the Guildhall), where all interested parties will be able to attend to state their views.  The Committee will consider all points raised and decide whether or not the consent should be granted.

11.  Successful applicants will be expected to maintain their furniture (i.e. tables, trestles etc.) in a clean and tidy condition at all times, and any awnings must be in green and white stripes as shown on the photo on the main street trading webpage.
