Introduction
Part 1 of the Vehicles (Crime) Act 2001 introduces powers to
regulate the motor salvage industry and requires motor salvage
operators to register with local authorities and to keep
records.
The Motor Salvage Operators Regulations, which came into force
on 21 October 2002, make detailed provision for the keeping of the
register by local authorities, application for registration and
requirements for record keeping by registered persons.
Requirement of Registration for Motor Salvage Operators
a) A person is required to be registered as a motor
salvage operator if he carries on a business, which consists:
i) wholly or partly in the recovery for re-use or
sale of salvageable parts from motor vehicles and the subsequent
sale or other disposal for scrap of the remainder of the vehicles
concerned;
ii) wholly or mainly in the purchase of written-off
vehicles and their subsequent repair or re-sale;
iii) wholly or mainly in the sale or purchase of
motor vehicles which are to be the subject (whether immediately or
on a subsequent re-sale) of any of the activities mentioned in
paragraphs i) or ii); or
iv) wholly or mainly in activities falling within
paragraphs ii) or iii).
b) An application for registration for a particular
area or for the renewal of such a registration:
i) Shall be made to the local authority in who’s area
the business is situated; and
ii) Shall be accompanied by a fee determined by the
authority.
Scrap Metal Dealers
The above legislation only applies to motor salvage
operators. If you are currently registered under the
Scrap Metal Dealers Act 1964 you only need to register as a
motor salvage operator if you also deal in motor vehicles, as
defined in items i) to iv) of a) above.
Waste Management Licensing
Operators may also need an "End of Vehicle" Licence from the
Environment Agency. Details are available on their website at
http://www.environment-agency.gov.uk.

All persons applying to be registered will need to attend our
offices at Bath Street and will need to bring the following:
- Correct fee - £83 for a new application (£60 for a
renewal);
- Competed application form;
- Completed police “Disclosure of Criminal Background” form -
please use a separate form for each applicant;
- Means of identification - drivers licence, passport, recent
utility bill, bank or credit card statement.
NB Fees stated are for the period 1 April 2008 - 31 March
2009.
