25 Provisional Statements
25.1 Where premises are being or are to be
constructed for the purpose of being used for one or more
licensable activities, or are being or about to be extended, or
otherwise altered for that purpose, a person may apply for a
Provisional Statement if they have an interest in the premises,
and, if they are an individual, they are aged 18 years or
older.
25.2 An application for a Provisional Statement must
be accompanied by a schedule of works that includes details of the
licensable activities for which the premises will be used; a plan
of the premises; and such other information as may be
prescribed.
25.3 Applications for Provisional Statements will be
dealt with in a similar manner as applications for a Premises
Licence. See also paragraph 23 relating to Operating
Schedules.
25.4 Where relevant representations are made in
relation to an application for a provisional statement the
Licensing Authority must decide whether, if the premises were
constructed or altered in the way proposed in the schedule of works
and if a Premises Licence was sought for those premises, it would
consider it necessary for the promotion of the licensing objectives
to attach conditions (subject to the provisions of paragraph 20),
rule out any of the licensable activities applied for, or to reject
the application.
